Franz trying to Initiate combat with it turned off

As stated in the title franz is trying to initiate combat, Rolling for initiative, with the turn based combat setting off. I don't know why this is triggering as turning term based combat off used to not have Franz ask to role for initiative. It(Franz the AI) does this in other campaigns too so it's not specifically to this campaign.
