Franz is claiming that a first level spell is a third level spell and refuses to let me cast it

I've made multiple attempts to reason with him and show him that he's incorrect, to which he concedes and says that it is a first level spell, but then when I try to resume the scene, he goes right back to saying it's a third level spell when it isn't.
