AI recognizing Magic initiate outside of combat but not during combat

Happened in every campaign so far, and it only happens when the class is a full martial with magic initiate, the AI automatically shuts the player down and says “Martial can't cast spells.” even if you announced that you are using your Magic initiate feat.

However outside of combat Franz recognizes it and let's you cast. This specifically only happens during combat.
